Business Innovation and Investment (Permanent) Visa (subclass 888)

 

188E is a provisional visa is for people who must be undertaking, or proposing to undertake,  complying with entrepreneur activity in Australia. This complying entrepreneur activity must be related to an innovative idea.

​

  • You must have held 188E continuously for at least 4 years and demonstrated overall a successful record of undertaking entrepreneurial activities in Australia before applying for an 888E permanent visa.

​

  • You must be nominated by an Australian state or territory government agency. You can be either in Australia or overseas when you lodge your application.

​​

  • You must have at least competent English.

​

  • You must have one or more legally enforceable agreements to receive funding with a total of at least

       AUD$200,000.

Key Requirements

Age
Be under 55. 
If you are aged 55 or older at the time of the invitation to apply for the visa unless the State or Territory government agency has determined your proposed entrepreneur activity will be of exceptional economic benefit.
English
You must have at least Competent English for applying this 188E Visa. Your family members aged 18 or over, must have functional English, otherwise, they must pay an extra charge, called the second instalment, if they do not have functional English.
Points Test
No points test is required.
 
Receive an Invitation to apply
You must submit an Expression of Interest (EOI). If an Australian State or Territory government agency accepts your EOI and nominates you. Department of Home Affairs will invite you to apply for this 188E visa.
Be Nominated
You must be nominated by an Australian State or Territory government
agency before being invited to apply for 188E visa.
Have a complying entrepreneur activity
You must be undertaking, or proposing to undertake, a complying entrepreneur activity in Australia.  A complying entrepreneur activity must relate to an innovative idea that will lead to (1) the commercialisation of a product or service in Australia, or (2) the development of an enterprise or business in Australia. You must also have a business plan for the entrepreneurial entity.
 
Receive funding from an approved entity
You must have one or more legally enforceable agreements from eligible entities to receive funding with a total of at least AUD$200,000.
All of the funding provided or to be provided to the entrepreneurial entity under the agreement or agreements is unencumbered and lawfully acquired.
Not have a history of involvement in unacceptable activities
You and your partner must not have a history of involvement in business or investment activities that are of nature that is not generally acceptable in Australia.
Intent to live in a specific State or Territory
You must have a genuine intention to live for at least 2 years in the State or Territory in which you have made the this visa application.
Meet Health Requirement
You and any family members who apply for the visa with you must meet health requirement. 
Meet Character Requirement
You and family members aged 16 years and over who apply for the visa with you must meet the Department of Home Affairs (DHA) character requirement.
